WELLTH MASTERY

Draft, pending counsel review

This is a working draft prepared to brief legal counsel. It is not yet the binding agreement. Bracketed items are decisions still open.

Legal

Terms of Service and Client Agreement

Draft version 2026-09-10

These terms govern your participation in a WELLTH Mastery coaching program and your use of the WELLTH portal. Read them together with the Privacy Policy, which explains how your data is handled.

1. Scope of services

WELLTH Mastery provides health and performance coaching, education, protocol design and accountability. The program includes coaching calls, a personalised protocol, supplement and training guidance, daily check-ins through the portal, and coordination of laboratory testing through an independent physician.

WELLTH does not provide medical care, diagnosis, treatment, psychotherapy or emergency services. Sections 2 and 3 describe those boundaries in full.

2. Not medical care

WELLTH Mastery is not a healthcare provider. Coaches are not your physician. Nothing in the program, the portal, a protocol, a message or an AI-assisted suggestion diagnoses, treats, cures or prevents any disease or condition.

You agree to consult a licensed medical professional for any medical condition, before starting or stopping any medication, and before acting on lab results. Where a protocol conflicts with advice from your physician, your physician's advice governs.

3. Not therapy

Parts of the program work with identity, mindset, relationships and emotional patterns. That work is coaching, not psychotherapy or counselling. Coaches are not licensed mental health professionals and do not treat mental health conditions.

If you are experiencing a mental health crisis, contact local emergency services or a crisis line. Section 16 explains what WELLTH does when a crisis presentation appears.

4. Physician relationship

Laboratory panels ordered through WELLTH are ordered and reviewed by an independent licensed physician [name the physician or lab partner and the state of licensure]. That physician, not WELLTH, is responsible for the clinical interpretation of results and for any clinical follow-up.

WELLTH receives a copy of your results with your consent and uses them to shape your protocol. You may instead supply results from your own physician.

5. Peptides and prescriptions

WELLTH never prescribes. Where a protocol references a prescription medication or a peptide, WELLTH's role is limited to coordinating with a licensed prescriber and to education. Any prescribing decision belongs to that prescriber and you.

6. Term, fees and payment schedule

The program runs for the term stated in your program summary [default four months]. Fees, payment schedule and what is included by tier (Sovereign, Kinghood, Legacy) are set out in your program summary [attach the tier fee schedule].

Laboratory testing, physician fees, supplements, wearables and any third-party services are billed separately unless your program summary says otherwise.

7. Refund and cancellation

[Counsel to draft: cooling-off period, cancellation notice, pro-rata treatment of prepaid fees, and non-refundable third-party costs].

8. Client responsibilities

  • Disclose all known medical conditions, allergies, medications and supplements before the program starts and whenever they change.
  • Answer intake questions and daily check-ins honestly. The protocol is only as good as the data behind it.
  • Follow the protocol as agreed, or tell your coach when you are not, so it can be adjusted.
  • Keep your portal credentials private and tell WELLTH at once if you believe your account has been accessed by someone else.
  • Seek medical care when you need it. The program does not replace it.

9. Data and privacy

The Privacy Policy describes what WELLTH collects, where it is stored, who can see it, how long it is kept and how to request export or deletion. It lists every third-party service that receives your data. It forms part of this agreement.

10. Recording consent

Coaching calls are recorded and transcribed so your coach can prepare, so nothing is lost between sessions, and so your protocol can be refined. By joining a call you consent to its recording and transcription. You may ask for a segment to be treated as off the record; that segment is removed before the transcript is stored.

11. Longitudinal and anonymized use

WELLTH improves its protocols by studying what works across clients over time. You agree that your data may be used in de-identified, aggregated form to inform protocols and coaching for other clients, to train and evaluate WELLTH's own tools, and for internal research. Data used this way is stripped of your name, contact details and any other direct identifier.

WELLTH will not publish your identity, results or story as a testimonial or case study without your separate written consent.

12. Confidentiality

WELLTH keeps what you share confidential, subject to the Privacy Policy and to any legal obligation to disclose. In turn, you agree to keep the program materials, frameworks and protocols confidential and not to share them with third parties.

13. Intellectual property

The frameworks, protocols, templates, portal software and program materials are and remain WELLTH's property. You receive a personal, non-transferable licence to use them for your own program during and after the term. Your own data remains yours.

14. Limitation of liability

[Counsel to draft: exclusion of indirect and consequential loss, cap tied to fees paid, carve-outs required by law, assumption of risk for physical training].

15. Dispute resolution and governing law

[Depends on the entity and its state of formation. Counsel to set governing law, venue, and whether disputes go to mediation or arbitration first].

16. Emergency and escalation

If a lab result shows a critical value, WELLTH will contact you promptly and direct you to the ordering physician or to emergency care. If a coach believes you are at risk of harm to yourself or others, WELLTH may contact emergency services and, where appropriate, an emergency contact you have named. WELLTH is not an emergency service and cannot guarantee a response time.

17. Changes and contact

WELLTH may update these terms. Material changes will be presented in the portal for acceptance before they take effect. Questions go to [legal contact email].
